Service of Judicial Documents
in
Uruguay

Service in Uruguay can be accomplished by utilizing the Inter-American Convention or by private agent (attorney). It should be taken in to consideration that Rule 4 of the Federal Rules of Civil Procedure. In addition, please be aware that Federal Rule 4, and many state statutes, indicate that service shall be made by any internationally agreed means (treaty or convention) or by an entity "authorized to make service" (these states include Alabama, Alaska, Arizona, California, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Idaho, Kansas, Maine, Massachusetts, Minnesota, Missouri, Nebraska, New Jersey, North Carolina, Ohio, Oklahoma, Rhode Island, Tennessee, Texas, Utah and Vermont). A judgment obtained on the basis of private agent service may be ruled invalid and not enforceable in the destination country.

Treaty service can often take 6-8 months or more to effect. Because of this, we will provide an affidavit that will indicate service is in progress, in compliance with applicable statutes and the reasonably expected time it will take to complete. This would support a motion to extend, which is usually necessary, and is provided at no additional cost.

Service through the Inter-American requires 7 pages of treaty documents. All documents to be served, including the treaty documents, must be translated into Spanish.

For us to prepare the convention documents and facilitate the service, we would require the following:

  1. A complete set of the filed summons, complaint and any other documents to be served. Please make sure that any defendant being served as a "Doe" entity is named in an Alias Summons;
  2. Full name of the judge who will be signing the request;
  3. Full name, address, and phone number of the court hearing this case;
  4. Full name, address, and phone number of the entity to be served;
  5. Full name, address, and phone number of the plaintiffs;
  6. Full name, address, and phone number of the specific attorney to act as plaintiff contact;
  7. Our fee of $595 to prepare the documents and handle the details. Additional shipping and copy costs are incurred if the documents exceed 75 pages (a minimum of $25 and increased relative to the size of the documents). You will also be responsible for any judicial expenses invoice;
  8. Translation fees @ $60 per page if we provide the mandatory translation (double spaced and typed; single spaced and other documents are priced upon viewing).

Private agent service fees average $795 to $995 in a major metropolitan area, such as Montevideo, but are dependent upon the location of the service. A quote of the cost for a specific location can be obtained. If this is the method you choose, we require a signed agreement from you indicating you have been informed of the potential problems.
